Shin Hae Chul's family has filed a claim for damages worth 2 billion won against the Seoul Sky Hospital and its director, reports Soompi, two weeks after the rock star's death was found to be caused by medical negligence.

The family of Shin Hae Chul was reported to have filed their case on March 16 according to a press release by KCA Entertainment, the rock star's agency.

In early March, a three-month police investigation concluded that the hospital director was guilty of negligence after operating on the rock star. After performing a surgery on the singer's gastrointestinal tract, the director was found to have ignored signs of complications which then led to the rock star's heart attack and subsequent death several days after.

“After the surgery, my husband was suffering from bouts of pain in his chest and abdomen,” said Shin’s wife Yoon Won Hee to Yonhap News in a phone interview on Oct. 30, shortly after the singer's passing.

“The day after the surgery, the doctor told us that during the last part of the surgery, the doctor stapled his stomach to make it smaller. But we weren’t told about the procedure nor did we agree to that part of the surgery."

“When we complained, the doctor just responded that the operation was necessary in his judgment,” said Yoon. “It was a surgery we never asked for, and [Shin] was suffering so much pain after the surgery. But the hospital just said the pain would go away after a while.”

Soompi reports that the hospital director is going through a reorganization proceeding, which forces Shin Hae Chul's family to file a case for compensation. Still, the legal representative for the deceased's family expects to win "at least half" of the 2 billion won from the claim, the report said.

But the matter becomes more complicated since the hospital director has filed for bankruptcy, according to Soompi. The director is also reportedly burdened with over 9 billion won in debt and has seen a hospital project with foreign investors fall through because of the Shin Hae Chul developments.

Whether Shin Hae Chul's family is awarded their claim should be determined by the court, but they can take a bit of comfort knowing that the rock star is loved enough that fans and supporters plan to erect a street monument to honor his legacy.
