SM Entertainment Reportedly Takes Legal Action Against Chinese Cosmetics Company For Unauthorized Use Of Former EXO Member Luhan's Pictures

A Chinese cosmetics brand is the subject of SM Entertainment's latest legal action.

Chinese cosmetics company KanS allegedly did not get permission from SM Entertainment to use two pictures of former EXO member Luhan for a recent ad campaign.  The photos in question were reportedly taken during the time when the Chinese star was actively promoting as a member of SM Entertainment's popular boy band.

The Korean record label alleges both photos were used without permission and that the KanS did not follow the appropriate copyright protocol to ask if Luhan's photos could be used on the advertising posters.

KanS used two pictures of Luhan on the same advertisement.  The first photo where Luhan holds a heart up to his eye was originally used in another Chinese advertisement that was authorized by SM while the singer was still an active member of EXO. The other photo, used on what appears to be a promotional pillow, was also taken when he was participating in activities with the group.

On December 11th, SM Entertainment released an official statement regarding their plans for legal action against KanS. "We've confirmed that the copyright on the photos, which the cosmetics company used, belong to SM, and collected data on it," they said. "We are in talks with our lawyers regarding what action to take against the related party."

"I'm kind of surprised they would do that, did they think no one would notice or?" commented Monsterlulu on an allkpop forum discussing the situation. "Not to mention its unprofessional on a business stand point."
