Prosecution Calls For Bobby Kim To Serve A Year In Prison For Assaulting Stewardess: Singer Blames It On 6 Glasses Of Wine

If South Korean prosecutors have their way, Bobby Kim will received a yearlong prison sentence, two years of probation and a $4,500 fine, for an incident on a Korean Air flight from Incheon to San Francisco on Jan. 7 in which the 42-year-old R&B vocalist allegedly grabbed a 27-year-old female member of the flight crew whom he had reportedly asked out.

The complaint was filed by Korean Air, who on April 28, were able to get Kim charged with violating air safety regulations with his behavior, according to a report Tuesday in the Korea JoonAng Daily.

On Monday, Star News revealed a statement the former pop star had allegedly made to police during their investigation, in which he blamed the entire incident, which reportedly began when the airline gave Kim a ticket in economy class when he'd upgraded to business class, on intoxication.

"There was an issue with the seating classes, so I complained," Kim said.

"However, the seat never got changed. So, I was sitting in the economy seats and in order to try to sleep, I drank six glasses of wine...I did make a scene because I was drunk, but I can't remember anything specific that happened, because I was so drunk."

According to a report published Thursday by the Korean news agency Osen, the prosecuting attorney described Kim's air rage incident in detail in court, describing how the singer repeatedly grabbed her arm of the stewardess, while continuing to pester her for her phone number and the location of her hotel and repeatedly kicking the seat in front of him.

"You made a settlement with the flight attendant, correct?" the judge reportedly asked Kim.

When the singer confirmed that he had, the judge allegedly appeared to accuse the prosecutor of overreaching.

"No similar cases have been given imprisonment," the judge reportedly said. "The maximum penalty given was a $4,500 fine."

The prosecutor then reportedly added the $4,500 fine to his list of damages.

According to local legal reports, the trial was mainly to determine whether Bobby Kim could be charged for assault. For this, again the defense offered intoxication as their only explanation.     

"We do not have an excuse for this, but please do take into consideration everything that happened up until the point of intoxication," Kim's lawyer reportedly said.

"He was in a bad mood, because he had to sit in the economy seat. He drank so he could fall asleep faster and it made him act in a certain way. We acknowledge he was drunk and he will take full responsibility for it...He wanted to drink himself to sleep, because he was upset.

The lawyer reportedly asked the judge to consider Kim's fans.

"He hasn't participated in any music activities since the incident took place," he said. "Please let him return to his fans that love his music...we have no excuses and what happened shouldn't be taken lightly. He just acted out of character, because he was drunk and upset. It was just typical drunk behavior. He's been self-reflecting and he feels very bad about what happened."

Citing the three-year prison sentence Seoul Central District Court prosecutors had sought after former GLAM vocalist Kim Dahee and model Lee Ji Yeon attempted to blackmail actor Lee Byung Hun, Kim fan Kevin Chan of Nashville, Tennessee sees a double standard when it comes to prosecuting male celebrities.

"[Prosecutors attempt to get] two young girls that blackmail Lee Byung Hun a three-year sentence and couple of years probation," Chan wrote in a Facebook comment on Tuesday. "This guy gets a year for sexually assaulting someone. Facepalm yourself South Korean judicial system."

Daniel Schlotte believes prosecutors are letting Kim off easy.

"I've been a fan of his for years, but he got off too light for sexual assault," Schlotte posted on Tuesday in the same Facebook thread started by Han Cinema.

Though he agreed with Chan that there is an unfair bias against women in South Korea's justice system.

"South Korea [has] a clear double standard when it comes to the gender of the offender," he wrote.

Florence Lim pointed out what many fans must be thinking.

"There goes his career," she wrote.

Kim will reappear in court on June 11.
