On Aug. 19, legal representatives for former EXO member Luhan and SM Entertainment met for the first court date to resolve the lawsuit that Luhan filed in October of last year. After some deliberation, Soompi reports that the judge presiding over the case decided to continue mediation on another court date. The representatives will return to court on Sept. 14.

Luhan's legal team Hankyul released a statement explaining that in addition to their suit for an unfair contract, they'd also be going after SM Entertainment for embezzlement.

"The lawsuit was filed due to an unfair contract. We also filed an additional suit for SM's embezzlement and professional negligence," said one of Luhan's representatives from Hankyul.

Lawyers from Hankyul added that in addition to not receiving the correct payment according to his contract, Luhan was never offered detailed documents about his income or benefits from being in EXO.

"That's an undeniable violation of the contract. While statements were always requested, it was always pushed back under the reasoning that they had no time. Following, what we want is to receive proper statements and proper payment," explained a Hankyul representative.

Meanwhile, SM Entertainment's legal team BKL offered up a defense that Luhan was aware he would not immediately reap the benefits of performing.

"It wasn't a situation where the profits were abundant. Luhan knew that he hadn't been able to yield benefits in the company yet, and his income wasn't something that was important to him at the time," said a BKL representative.

Based on the decision from the judge, and the already currently lengthy time that has passed since the lawsuit was first filed, Luhan's contract with SM Entertainment may long be under negotiation.

Luhan has apparently not let the situation keep him down. Recently it was reported that he has begun preparations for his first solo music album "Reloaded." There is no release date set for the album, but it is said to be in the "countdown phase" of creation.
