Eminem Suing Facebook: Social Network Uses Rapper’s ‘Under The Influence’ Song in Mark Zuckerberg’s Webcast

The Detroit rapper's music publishing company Eight Mile Style, Eminem, is suing Facebook and its advertising agency, Wieden + Kennedy of Portland, Ore. The 12-page complaint was filed Monday evening in Detroit federal court. The firm is charging the social networking company over a song used in a 30-second webcast called Airplane. This song, according to Eminem's company, resembles one of the rapper's track called Under the Influence.

The advertisement was featured in Facebook founder, Mark Zuckerberg's webcast that went online last April 4 announcing Facebook's new interface for Android phones, Facebook Home. With its release, some viewers noticed the similarity between Eminem's track and the ad's music. The Detroit Free Press reported that Facebook later removed the controversial background music and changed it with a new one prior to the advertisement's release on YouTube and on TV.

Eight Mile Style's lawyers say thatbecause they altered the Airplane advertisement, Facebook knew it had infringed Eminem's track. With this, the firm wants up to $150,000 per infringement of Eminem's song.

This is not the first time that Eminem's music publishing company has been involved with copyright infringement cases. In 2005, Eight Mile Style had an out-of-the-court settlement with Apple Inc. for using Lose Yourself in an iPod commercial without their permission.

In 2011, the company had a settlement with Audi after using a sound-alike song to Lose Yourselfin one of their European promotional clip.

In response to the complaint by Eight Mile Style, Wieden+Kennedy's attorney said in April 29 that Eight Mile Style had no grounds to allege copyright, saying that his song has been copied from Michael Jackson's song Give In to Me in 1991. However, Eight Mile Style's lawyer explains that Under the Influence was co-written by D12 and produced by the Bass Brothers and has no connection to the King of Pop's song.
