Jodi Arias Sex Details Transcript Unsealed; Alexander Not the Virgin Witnesses Said

Jodi Arias graphic sex details are on the latest transcripts from the trial to be unsealed. Arias was found guilty of the brutal first-degree murder of her boyfriend, Travis Alexander, in May. The jury was unable to reach a unanimous decision on whether to sentence Jodi Arias to life sentence or to impose the death penalty for the gruesome 2008 slaying. A new trial date for penalty phase was set for July 18.

In February, Jodi Arias’ graphic sex details were unveiled when Jodi Arias’ defense attorney, Jennifer Willmott, played a recording of a phone sex session between Arias and Travis Alexander, the lover she killed. Newspapers obtained a a transcript of the Jan. 31 in-chambers hearing that put the steamy recording into evidence on Friday.

Maricopa County Superior Court Judge Sherry Stephens, who presided over the case, unsealed some of the bench conferences and in-chambers arguments that took place during the trial. Juan Martinez, the prosecutor, attempted to dismiss the tape-recording as hearsay at the Jan. 31 hearing. The prosecuting attorney claimed there was no verification that the woman's voice on the recording belong to Arias.

According to the transcript, Martinez wanted to argue in chambers because, "What I'm trying to avoid is having to squawk up like a Jack-in-the-box every five minutes" with objections. Martinez said "And rather than making a big fight out there, I guess, I'm wanting to make the big fight here." The tape was recorded a month before the murder, in May 2008. The scandalous tape was aired for millions of viewers who had been mesmerized by the trial on TV. The tape shows Alexander saying that he wanted to tie Arias to a tree and sodomize her. Alexander also described other acts on the tape that he would like to perform and photograph with Arias. In the tape Alexander used porn-movie terms to graphically explain what he wanted to do to Arias.

At the hearing, Martinez argued that there was no proof that Alexander actually performed those acts. One of Arias’ defense team responded that the intent of playing the tape was to show that Alexander was sexually aggressive with Arias. The defense lawyer said the tape showed that Alexander was not the virgin that some witnesses testified they believed him to be.

Kirk Nurmi, another defense attorney for Arias, said "it relates to the abusive and exploitative relationship which is entirely relevant to not only her self-defense, but also anything that can give rise to sudden heat of passion," which meant second-degree murder or manslaughter. Nurmi said, "Again at a time when she is supposedly this crazy stalker person that he doesn't want around, he's having phone sex with her and talking about the things that he wishes to do."

Martinez argued, "He's not the aggressor, she is."

The jury did not believe the argument from the defense.
