Kanye West Sued for ‘Bound 2’ Sample; Heard It On the Radio; West Says He Paid for It, But Not to Who Owned It

Kanye West's Yeezus can't stop generating controversy, even on Christmas Eve. Kanye is being sued for a sample on his "Bound 2" track. It seems some vocals were lifted from a 12 year old song called "Bound." Not only is West's song not a sequel, he never got permission to use the sample. The singer heard about it for the first time on the radio.

Ricky Spicer was in the boy band Ponderoa Twins Plus One. Twelve years ago the band put out song called "Bound." Kanye West sampled Spicer's vocals for his Yeezus track "Bound 2." Now Singer is suing West.

The Daily News reported that Ricky Spicer first heard "Bound 2" on the radio. He never gave Kanye permission for his voice to be used. Kanye's "Bound2" was named for Ponderoa Twins Plus One's single, but never got around to sending out the notice. Ponderossa Twins Plus One was a teen R&B-soul group out of Cleveland. It featured the Gardner and Pelham twins. Spicer was the Plus One. They had a few hits but broke up in 1975. The song "Bound" was off the Ponderossa Twins Plus One's 2+2+1 = album.

Ricky Spicer, 56, filed suit in Manhattan Supreme Court on Monday, against Kanye West, Roc-A-Fella Records, Island Def-Jam Music, Rhino Entertainment, and Universal Music Group. Spicer says the rapper can't use the 1971 song without permission. The lawsuit demands that West either pay up or face the wrath of a cease and desist order.

The lawsuit says  "Mr. Spicer's voice is sampled exactly as he recorded it."

Kanye says he bought the rights to "Bound" off All Platinum Records, but they might not own it.

Boun 2 was produced by West and Che Pope. Charlie Wilson did vocals on it. Bound 2 was the second single off Yeezus. "Bound 2" also used samples from Wee's "Aeroplane (Reprise)" and Brenda Lee's "Sweet Nothin's".
