Tracy Morgan Accident Update: ’30 Rock’ Actor ‘Fighting Hard Everyday To Get Back;’ Speaks Out After Walmart Claims He’s At Fault For Own Injuries

Tracy Morgan accident update points to the "30 Rock" actor hitting back at Wal-Mart after the retail company blamed him and his companions for not wearing their seatbealts during the accident along the New Jersey Turnpike. Meanwhile, the company is mum on the allegation that the driver hasn't slept in 24 hours.

"After I heard what Walmart said in court I felt I had to speak out. I can't believe Walmart is blaming me for an accident that they caused. My friends and I were doing nothing wrong," the actor said in a statement published on USA Today. "I want to thank my fans for sticking with me during this difficult time. I love you all. I'm fighting hard every day to get back."

The British tabloid MailOnline dished Tracy Morgan accident update when it reported on the reply by Wal-Mart filed on Monday to the lawsuit filed by the comedian in July.

According to the filing, Tracy Morgan and his companions, including comic James McNair who died in the crash, were injured due to their "failure to properly wear an appropriate available seatbelt restraint device."

The lawyers said this is in violation of the law and had they been wearing seatbelts, "all or a portion of the injuries could have been diminished or minimized."

Also it claimed that the injuries suffered by Tracy Morgan and his entourage "may have been caused by third parties over whom Wal-Mart had no control."

In the Tracy Morgan accident update by BBC in July, the "30 Rock" actor filed a lawsuit against Wal-Mart after alleging that the company knew its truck driver, Kevin Roper, did not comply with federal rules on driver fatigue.

Tracy Morgan's assistant, Jeffrey Millea, and comedian Ardie Fuqua Jr. were also injured in the massive crash in New Jersey turnpike.

"As a result of Wal-Mart's gross, reckless, wilful, wanton, and intentional conduct, it should be appropriately punished with the imposition of punitive damages," BBC reported, quoting court papers.

Tracy Morgan was releaed from the rehabilitation center as the doctors gave him the permission to continue his rehab at home.

"He asked me to pass along his sincerest gratitude to everyone who has helped him get to this point. He would also appreciate some privacy during this crucial point in his recovery," spokesman Lewis Kay said in a statement following Tracy Morgan's release.
