Tracy Morgan accident update reveal that the "30 Rock" actor is looking a little worse for wear in a recent outing. Meanwhile, the comedian's lawyer lashed out at Wal-Mart's arguments.

The British tabloid MailOnline dished out Tracy Morgan accident update when it published photos of the comedian bound to the wheelchair when he arrived at the New York hospital for a doctor's visit with her baby daughter and fiancée.

But Tracy Morgan declined to comment when prodded by reporters following Wal-Mart's court arguments blaming him and his entourage for not wearing their seatbelts during the crash.

According to the filing by Wal-Mart, Tracy Morgan and his companions, including comic James McNair who died in the crash, were injured due to their "failure to properly wear an appropriate available seatbelt restraint device."

The lawyers said this is in violation of the law and had they been wearing seatbelts, "all or a portion of the injuries could have been diminished or minimized."

The comedian already released a statement days ago where he said: "After I heard what Walmart said in court I felt I had to speak out. I can't believe Walmart is blaming me for an accident that they caused."

"My friends and I were doing nothing wrong. I want to thank my fans for sticking with me during this difficult time. I love you all. I'm fighting hard every day to get back."

The PageSix also provided more Tracy Morgan accident update when it reported what lawyer Benedict Morelli claimed the doctors said.

"The jury's still out" whether Tracy Morgan will ever perform again. "The doctors don't know the answer. I don't know the answer."

The lawyer also lashed out at Wal-Mart as he called their executives "despicable."

"They knew that they changed these people's lives forever and killed somebody," he said. "They're good blame shifters. I guess that's how they make $783 billion a year, shifting the blame."
