Tracy Morgan accident update reveals that his future gigs are in limbo as doctors remain unsure whether or not the comedian will ever perform again. But the "30 Rock" actor is still thankful despite Wal-Mart's recent argument to blame him for not wearing seat belts.

The comedian's lawyer, Benedict Morelli, dished out Tracy Morgan accident update as he said that doctors have no idea whether the comedian will ever tour or step on stage again.

"The jury's still out," on how the Tracy Morgan accident will affect his means of income. "The doctors don't know the answer. I don't know the answer," he added.

The Wal-Mart's defense centers on blaming the comedian and his entourage, including comic James McNair who died in the crash, as their injuries were caused by their "failure to properly wear an appropriate available seatbelt restraint device."

The lawyers said this is in violation of the law and had they been wearing seatbelts, "all or a portion of the injuries could have been diminished or minimized."

Also it claimed that the injuries suffered by "30 Rock" actor Tracy Morgan and his entourage "may have been caused by third parties over whom Wal-Mart had no control."

In the Tracy Morgan accident update by BBC in July, the "30 Rock" actor filed a lawsuit against Wal-Mart after alleging that the company knew its truck driver, Kevin Roper, did not comply with federal rules on driver fatigue.

Tracy Morgan's assistant, Jeffrey Millea, and comedian Ardie Fuqua Jr. were also injured in the massive crash in New Jersey turnpike.

"As a result of Wal-Mart's gross, reckless, wilful, wanton, and intentional conduct, it should be appropriately punished with the imposition of punitive damages," BBC reported, quoting court papers.

Tracy Morgan blasted Wal-Mart for blaming them, however, the "30 Rock" actor is still thankful that he's alive, said People.

"I want to thank my fans for sticking with me during this difficult time. I love you all. I'm fighting hard every day to get back."
