Tracy Morgan's Lawsuit Versus Wal-Mart Proceeds Without Delay; Driver In Car Crash Questions '30 Rock' Actor's Financial Trouble Claims

The lawsuit filed by Tracy Morgan versus Wal-Mart will proceed without delay, as the driver in the car crash questioned the financial trouble claim made by the "30 Rock" actor.

"A federal judge on Friday refused to delay the lawsuit," said Fox News. "The ruling came on a motion by Kevin Roper, the driver of the Wal-Mart truck authorities say slammed into the back of Morgan's limo van on the New Jersey Turnpike in June."

Tracy Morgan filed a civil case lawsuit against Wal-Mart, which reportedly allowed the defendant to drive the truck straight even with lack of sleep. The retail giant has hit back as it claimed that it's the comedian's fault for not wearing a seat belt.

The attorney for Kevin Roper, who pleaded not guilty to charges of vehicular homicide and assault, had filed a petition to delay the Tracy Morgan's lawsuit against Wal-Mart at least until his separate criminal case is resolved. But US District Judge Michael Shipp threw out the petition as he said that the defendant failed to prove "emergent relief."

"Roper's attorney, David Glassman, said the civil case can taint his client's criminal case if it's allowed to proceed first. He said Roper will, in effect, be on trial in the civil case since he was driving the truck," the report added.

Meanwhile, Kevin Roper slammed Tracy Morgan's lawsuit against Wal-Mart, especially his claims about being strapped for cash,

"Roper seems to say in legal docs ... Morgan's financial woes don't hold a candle to his. And his evidence of that is the fact that Morgan was being driven in a fancy limo, and Roper's just a truck driver," TMZ said.

The New York Daily News reported that Tracy Morgan's lawsuit versus Wal-Mart stemmed from the fact that the comedian couldn't get back to work. "Given his financial hardship, he needs the money he might get from a favorable judgment," it said.
