Greg Allman Biopic ‘Midnight Rider’ Producers Sue Insurance Company for Refusing to Pay $1.6 Million Claim

The producers of  the Greg Allman Biopic "Midnight Rider" sued its insurance company New York Marine. The producers claim the insurer refused to pay claims after the production halted and incurred at least $1.6 million in losses.

Film Allman, the production entity set up by director Randall Miller and producer Jody Savin to make the film, filed the lawsuit in Los Angeles Superior Court on Tuesday.

The production company claims in the lawsuit that its losses "are clearly covered under the policy that New York Marine issued in connection with 'Midnight Rider'" but that the insurer has "refused to pay the claim pursuant to an agreed-upon schedule. Even worse, New York Marine unjustifiably has taken the position that the policy will no longer insure 'Midnight Rider' on a forward going basis and has threatened to cancel the policy altogether, thereby leaving Film Allman without any insurance coverage for the restarted production."

Sarah Jones, 27, died during shooting "Midnight Rider," the ill-fated Greg Allman biopic. Seven other crew members were injured. Jones was fatally struck by a freight train on the set of Midnight Rider.

Second camera assistant Sarah Jones was killed near Jessup, Georgia during the first day of shooting "Midnight Rider," The day's shoot was of a dream sequence on a railroad trestle, with a hospital bed on the tracks. Jones was killed when a train came across the bridge. The crew was hit was debris. Jones was knocked into the path of the train by debris from the bed.

The parents of Sarah Jones sued 10 individuals, including director Randall Miller, and eight corporations, including CSX Transportation, which owns the railroad tracks where Feb. 20 tragedy took place, Film Allman and Unclaimed Freight Productions. Singer Gregg Allman was sued along with others accused of being responsible for the February death of the young camera assistant.

The film "Midnight Rider" is based on legendary rocker Gregg Allman's memoir. Weeks ago, Allman recently settled a lawsuit with producers designed to stop director Randall Miller from continuing with the film after a train killed camera assistant Sarah Jones while working on the project in southeast Georgia.
William Hurt, who was set to play Gregg Allman in the film, dropped out of shooting.

Besides working on Midnight Rider, Sarah Jones was also a crewmember on "The Vampire Diaries."
