Kelly Rutherford's Battle For Kids Comes To A Close; Actress Loses Her Six-Year Fight

Kelly Rutherford's fight for her kids has met a brick wall.

On Thursday, Rutherford was informed that she no longer has the right to fight for custody of her two young children in the state of California. She officially lost a battle that she has been fighting for for the last six years.

The 46-year-old's attorney, David J. Glass, told Us Weekly that a judge in Monaco, where Rutherford's ex-husband Daniel Giersch lives, had given him full custody of their children, Hermes, 8, and Helena, 6.

"We are extremely disappointed with the ruling," Glass told Us. "Although the Court agreed with our analysis of the law, and in fact agreed with our position that citizens can have more than residence for jurisdictional purposes, the Court ultimately did not agree with us on the facts."

It's bittersweet and heartbreaking news for the "Gossip Girl" star who currently has her two children with her. Hermes and Helena are temporarily in New York City after a judge at Monaco's Palais de Justice ordered that the children live with their mother for the summer.

Rutherford and 41-year-old Giersch, a German businessman, were married in 2006. The actress filed for divorce in 2008 while pregnant with their daughter. They have since been in an ugly custody battle over the children.

Kelly Rutherford's battle for her kids has even prompted her to start a petition to the White House to bring her kids back to the U.S., which currently has over 119,000 signatures.

The actress has been shuttling back and forth from the U.S. to Monaco to see her children after a California judge sent them to live with their father in France in 2012, as his U.S. visa had been revoked.

In December 2013, a court decided that Giersch no longer had to pay for his kids to visit the States and their mother.

In an article posted by Entertainment Tonight in May, it was revealed that Kelly Rutherford's fight for her kids has cost her about $2.5 million. She even filed for bankruptcy in 2013, claiming $2 million in debt, including $1.5 million in legal fees and travel fees to see her kids.

"It cost me everything I've ever made," she told ET.
