It seems Halle Berry is sick of forking over what she sees as exorbitant child support payments to ex-boyfriend Gabriel Aubrey. The Oscar winner has filed legal documents asking a judge to reduce her monthly obligation from $16,000 to just over $3,000, contending that the model is abusing the system. Aubrey, for his part, reportedly plans to contest the request, as he feels the current payments are necessary to adequately provide for their daughter.

TMZ reports that Berry’s legal docs claim that Aubrey has stopped working altogether, becoming completely dependent on her payments. Child support is supposed to go toward the child, not the parent, and Berry believes that if her ex would just get a job the lower rate would be enough to provide a comfortable life for six-year-old Nahla when she is staying with her father. The former couple has joint custody, each spending about 50% of the time with their daughter.

Meanwhile, Radar reports that Aubrey will not go down without a fight. A source told the publication, “There is no proof that Gabe is abusing the system!” It seems that Aubrey does actually still work as a model, but is unable to do it full time because he is too busy taking care of Nahla. The source says that Berry’s ex has actually had to turn down many gigs because they required travel. 

This is not the first time Berry and Aubrey have gone to court over matters regarding Nahla’s care. They engaged in a bitter custody battle after they split in 2010. At one point, Berry wanted to take Nahla with her and then fiancé Oliver Martinez to live in Paris, which have meant cutting off almost all contact with Aubrey. While the actress believed the move would provide her daughter with a safer living environment, a judge barred the move after a child custody report found that it would be detrimental to separate her from her father. The two came to a reportedly amicable agreement in 2012, and things have appeared to be peaceful until now.
