CLC Elkie Requests to Terminate Exclusive Contract with Cube Entertainment Due to Unfair Treatment

CLC member Elkie has teamed up with a law firm and has submitted a request to Cube Entertainment to terminate her exclusive contract and for the agency to pay the money she is owed.

On Friday, Dec. 25, the Jing Shi Law Firm submitted a letter to Cube Entertainment, in which they detail the reasons why Elkie (real name Chong Ting Yan) is requesting her termination of contract, citing poor treatment, neglect, and withholding the money she earned. They also stated the company had told CLC they were going to no longer receive support from the company and had left them with no plans. She is requesting her contract to be terminated effective immediately.

The letter reads:

"To Cube Entertainment,

We are the legal counsel of Ms. Chong Ting Yan, and we are sending this letter concerning the issue of termination of the exclusive contract between your label and Miss Chong due to the following reasons.

According to the statement and materials provided to us by Miss Chong, she had signed an exclusive contract with Cube Entertainment in Feb. 2016. In the contract, it was stated that Cube Entertainment would be the only agency that will be exclusively managing Miss Chong's activities in entertainment. Following the signing of the contract, Miss Chong was added to the girl group CLC, and fulfilled her end of responsibilities that were cited in the contract, followed the agency's rules and arrangements, and used her time to train in acting as well. However, Miss Chong has claimed that Cube Entertainment violated a number of terms and conditions from the contract, as noted below:

First of all, during her contract period, Miss Chong's income that she got from her entertainment activities were collected by Cube Entertainment. However, the agency failed to release any income statements of any specific details to Miss Chong.

Secon, after she had signed the contract, Miss Chong fulfilled her side of the responsibilities outlined in the contract and participated in the schedules that she was arranged and required to do by Cube Entertainment. However, the agency failed to pay Miss Chong for her acting activities, which goes against Article 6.4 of her exclusive contract.

Third, due to Cube Entertainment's poor management and internal structure changes, the agency informed the CLC members that they would no longer be any development supported by Cube entertainment in 2020. Since then, the agency did not provide any reasonable plans for Miss Chong's future. Instead, your actions showed that you had no plans to longer fulfill the terms of her contract.

As stated above, Cube Entertainment is violating their contract and hindering Miss Chong's development and growth in the entertainment industry."

Notably, Jing Shi Law Firm ha stated that Elkie's exclusive contract with Cube Entertainment is over the moment they receive their letter. They are giving the company 15 days to submit proper income statements before they pursue further legal action.

"We have accepted Miss Chong's payment and are sending in this message on her behalf.

First, starting the day you receive this notice, the exclusive contract between you, Cube Entertainment, and Miss Chong, is terminated.

Second, within 15 days after receiving this letter, Cube Entertainment will provide Miss Chong with her proper income statement for her activities within the contract period and contract details to proceed with the settlement.

Third, if Cube Entertainment will refuse to follow the demands stated in this letter, we will use any legal means necessary to protect our client."

Elkie is not the first artist under Cube Entertainment to have a conflict with the company. In July 2019, Lai Kuanlin requested to terminate his exclusive contract with the label.
