Oscar Pistorius May Soon Be Out Despite Murder Case Appeal? 'Blade Runner's' Defense's Appeal Challenge Rejected

Oscar Pistorius may be out in just two months despite the pending appeal to upgrade his conviction from culpable homicide to murder.

Meanwhile, the appeal of the National Prosecuting Authority (NPA) to challenge the ruling of Judge Thokozile Masipa will continue with the court junking the attempt of Oscar Pistorius' lawyers to block the move.

 According to Eyewitness News, it won't be until the end of May when the NPA will submit its transcripts to the Supreme Court. By which time, both parties will file their respective arguments.

"This will most likely take around two months, which means it would be heard once Pistorius becomes eligible for early release," the website said.

Based on the previous ruling for culpable homicide in Oscar Pistorius' murder case, the "Blade Runner" could be out on parole around August and just serve the rest of the sentence under house arrest.

"Mr Pistorius will most likely be due for his release in months to come. It's generally in the hands of correctional supervision. We have no control on the time frames whatsoever at this time," Velekhaya Mgobhozi of the NPA told the website.

Meanwhile, the court nixed the attempt by the attempt of lawyers in the Oscar Pistorius' murder case to junk the NPA appeal to bring the case to another court. Judge Masipa had earlier granted the NPA petition.

"Prosecutors are pushing for the appeal because they believe that a full bench of judges in the Supreme Court of Appeal will agree with them that Judge Masipa misinterpreted the principles of dolus eventualis and will both convict him of murder and impose a longer sentence," the BBC reported

Under the law in South Africa, the lesser murder charge "applies if the accused knew they might kill someone but still went ahead with their course of action."
