Kelly Rutherford is taking custody battle matters for her kids into her own hands and keeping them in the US. But her ex-husband Daniel Giersch's camp claimed what she's doing is "child abduction."

As reported by Hollywood Life, the actress revealed she has no plans to take her children with Daniel Giersch back to Monaco even though she was originally supposed to fly them back there on Thursday.

In a statement to E! Online, Daniel Giersch's camp maintained that what Kelly Rutherford was doing with her kids is not good for them.

"Daniel will continue to protect the children from any harm and any media exposure," Giersch's lawyer Fahi Takesh Hallin explained in a statement to E! Online. "Unfortunately Kelly has now added child abduction to extortion and false statements on her list of actions. Daniel will make sure that the children's safety and well-being will be restored as soon as possible."

"He is very concerned about the traumatic impact that Kelly's behavior will have on the children," Hallin added, "Kelly was to have delivered the children in France to their father on Aug. 7, 2015."

"Child abduction is a crime, and everyone involved in kidnapping or abducting the children will face the appropriate legal consequences," the lawyer continued. "Anyone associating themselves with Kelly and her abduction is violating the law."

Rutherford has insisted as reported in Entertainment Tonight that after California and New York courts decided they have no jurisdiction over her custody battle case, no state can stop her apparently from keeping her children.

"It also means that no state in this country currently requires me to send the children away," she pointed out as well in her statement. "Hence, I have decided that I cannot lawfully send my children away from the United States to live in a foreign country."

The actress has been battling for the custody of her children with her ex-husband Daniel Giersch for years now.

"These past three years waiting for my children to come home have been very difficult," Kelly Rutherford said about fighting for her kids as quoted by People. "My children were forced to leave the United States in 2012 when they were only 2 and 5 years old."
