Head executives at SM Entertainment, the record label for EXO, have made good on their promise last week to pursue legal action against the person or persons who posted a practice performance performance of the group's new single "Overdose" online.

In an official company statement to eNEWS on Monday, SM Entertainment execs laid out exactly what legal course of action the K-pop powerhouse label, which is also home to Girls' Generation and Super Junior, would be taking against the as yet unnamed, alleged copyright violators.

"We have officially filed for criminal prosecution charges for copyright violations as well as a breach in the Prevention of Unfair Competition and trade secret protection laws at the Seoul Central District Prosecutor's Office," the SM statement read.

"Regarding strict legal liabilities, we will be dealing these cybercrimes in a strong and firm way. We are also preparing for other additional civil suits for all possible situations."

The leaked EXO video of "Overdose" was reportedly shot for an upcoming appearance on the South Korean music television program "Show! Music Core."

The record label's statement included another warning to Exo fans, or anyone else, considering reposting the link.

"We want to once again warn you to not engage in a second or third leak or any other illegal acts to prevent damages," the SM statement read.

EXO's new EP, also called "Overdose" hits stores on Tuesday.

To mark the occasion Exo has planned a "Comeback Show" at Seoul's Jamsil Arena.

And they should be up for the challenge; Exo is coming off of performing five nine-song sold out in three days, Thursday through Friday, at Saitama Super Arena, just outside of Tokyo, Japan.

Among the 100,000 Japanese fans who attended those performances, entitled "EXO Greeting Party in Japan, Hello!" was 18-year-old Japanese fan Daiske, who described to the Korea Times just how pervasive EXO's fame has become in her country.

"EXO's dance routines are covered in my school's talent show," she said.

"I like the band since they have powerful dance moves, even the male students were amazed [when they saw the routines]. But my jaw dropped at the sight of them dancing up close."

Concert attendee Katsue, 11, summed up the experience up in one line.

"They look much cooler than on YouTube," she said.
